ARTICLE 1 - GENERAL PROVISIONS


These Terms & Conditions (the "Terms") govern access to and use of the website operated under the brand 2DOLIST (the "Site"), accessible in particular at https://www.2dolistgo.com/.



2DOLIST USA LLC is a limited liability company registered in the State of Florida, USA, under the Florida Document Number L24000419298. The company’s registered address is: 7901 4th St N STE 300, St. Petersburg, FL 33702, USA.


These Terms & Conditions ("Terms") govern access to and use of the website operated under the 2DOLIST brand (the "Site"), accessible at https://www.2dolistgo.com.



The Site is an online information and discovery platform for leisure activities in the field of aviation and similar outdoor activities. In some cases, the Site may display links to third-party partners offering such activities.


By accessing or using the Site, any visitor or user (the "User") acknowledges that they have read these Terms and agree to be bound by them. If the User does not agree to these Terms, they must not use the Site.


2DOLIST may update these Terms from time to time. The applicable version is the one available on the Site at the time of access or use.



ARTICLE 2 - DEFINITIONS


For the purposes of these Terms, the following terms, whether used in the singular or plural, have the meanings set out below:


-         "Activities" means leisure and aerial activities (for example: scenic flights, hot air balloon rides, skydiving, helicopter tours, etc.) which may be presented or described on the Site.

 

-         "2DOLIST" means the company operating the Site under the 2DOLIST brand.

 

-         "Partner" means any third-party company or provider offering Activities or related services on its own website and to which the User may be redirected from the Site.

 

-         "Affiliate Links" means links or tracking technologies placed on the Site that redirect the User to a Partner website and may allow 2DOLIST to receive a commission or other compensation if the User makes a purchase or booking with the Partner.

 

-         "Site" means the website operated by 2DOLIST and accessible notably at 2dolistgo.com.

 

-         "User" means any person who visits, browses or uses the Site, whether or not they create an account or use Affiliate Links.



ARTICLE 3 - NATURE OF SERVICES


The Site is an informational and promotional platform. 2DOLIST does not sell Activities directly and does not act as a tour operator or activity provider on the .com website.


All bookings, purchases and payments for Activities presented through the Site are made directly with the relevant Partners on their own websites. Any contract for an Activity is concluded solely between the User and the Partner.


2DOLIST does not control the content, availability, pricing, safety, quality or actual performance of the Activities offered by Partners and cannot guarantee that such content is accurate, complete or up to date.



ARTICLE 4 - USER ACCOUNTS AND ACCESS


Access to most parts of the Site is provided free of charge and without the need to create a user account. 2DOLIST may, however, offer account-based features (for example: favorites, newsletters or saved searches).


When a User creates an account, they agree to provide accurate, current and complete information and to maintain the confidentiality of their login credentials. The User is solely responsible for all activities carried out under their account.


2DOLIST reserves the right, at its sole discretion and without prior notice, to suspend or terminate any account or access to the Site in case of misuse, violation of these Terms or any applicable law.



ARTICLE 5 - AFFILIATE LINKS AND PARTNER WEBSITES


The Site may display Affiliate Links, banners or other promotional content that redirect the User to Partner websites. When the User clicks on an Affiliate Link and completes a booking or purchase with a Partner, 2DOLIST may receive a commission or other form of compensation from that Partner. This does not affect the price paid by the User.


The presence of Affiliate Links or Partner content on the Site does not constitute a recommendation or endorsement of any specific Partner, Activity or offer by 2DOLIST. The User remains solely responsible for verifying that an Activity meets their needs and expectations.


Partner websites and services are governed by their own terms and conditions, privacy policies and cookie policies. Before making a booking or purchase, the User is invited to carefully review the applicable contractual documentation provided by the Partner.


2DOLIST is not a party to any agreement concluded between a User and a Partner and cannot be held liable for any dispute, cancellation, modification, refund request, accident or damage arising from an Activity or a transaction concluded with a Partner.



ARTICLE 6 - USER CONDUCT


The User agrees to use the Site in a lawful and responsible manner, and in particular agrees not to:


- Use the Site for any fraudulent or illegal purpose;

- Attempt to access data or systems without authorization;

- Interfere with or disrupt the operation of the Site or its servers;

- Copy, reproduce or scrape significant portions of the Site for commercial reuse without prior written consent from 2DOLIST;

- Upload or transmit any content that is offensive, discriminatory or infringes third-party rights.



ARTICLE 7 - INTELLECTUAL PROPERTY


All intellectual property rights relating to the Site and its own content (including but not limited to trademarks, logos, texts, designs, graphics and layouts) are owned by or licensed to 2DOLIST, unless otherwise indicated.


Subject to compliance with these Terms, the User is granted a limited, non-exclusive, non-transferable and revocable license to access and use the Site for personal and non-commercial purposes only.


Any reproduction, distribution, modification, public display or exploitation of the Site or its content for purposes other than personal use is prohibited without the prior written authorization of 2DOLIST or the relevant rightsholder.



ARTICLE 8 - LIMITATION OF LIABILITY


To the fullest extent permitted by applicable law, 2DOLIST shall not be liable for any indirect, incidental, special or consequential damages, including loss of profits, loss of data, business interruption or reputational harm arising out of or in connection with the use of the Site, Affiliate Links or any Activity booked with a Partner.


Information about Activities and Partners is provided on an " as is" and "as available" basis. 2DOLIST does not guarantee that the Site will be error-free, secure or available at all times.


Nothing in these Terms is intended to exclude or limit any liability that cannot be excluded or limited under applicable law.



ARTICLE 9 - PERSONAL DATA AND PRIVACY


When operating the Site, 2DOLIST may collect and process certain personal data relating to Users, for example when a User contacts 2DOLIST or subscribes to a newsletter.

By using the Site, the User acknowledges that they have read the Privacy Policy and agree to the described processing of their personal data.

These Terms and any dispute arising out of or in connection with them or the use of the Site shall be governed by and construed in accordance with the laws of the State of Florida, United States of America, and applicable federal law, without regard to conflict of law principles.


The parties agree to submit any dispute that cannot be resolved amicably to the exclusive jurisdiction of the competent state or federal courts located in Florida, United States of America.
